Data Protection Policy & Personal Data Protection Act (PDPA)

1.0 Privacy Policy

Pursuant to the Personal Data Protection Act 2010 (“PDPA”), Mailhappen Sdn. Bhd. (“MHP”) is mindful and committed to the protection of your personal information and your privacy.

2.0 Collection of Personal Data

2.1 Depending on the circumstances of the collection and also the nature of the services requested, these are the types of the Personal Data that we will collect directly from you or from third parties :

  • Personal information that links back to an individual, e.g., name, gender, date of birth, passport and other personal identification numbers and others domain name ownership information
  • Contact information, e.g., address, phone number and email address.
  • Payment information, e.g., Banking information / credit card detail is kept on our server except all transaction will be immediately handled by our gateway partners
  •  Technical information, e.g., IP address.
  • Statistical Data, e.g., Website visits statistic

2.2 This Privacy Statement covers any Personal Data provided to us:

  • When making an orders with us.
  • Via any online sites operated by MHP and its contractors.
  • Under any other contractual agreement or arrangement.
  • Via a third party, e.g., Channel partners or agents.

2.3 Some of the other ways we may collect Personal Data also include (but is not limited to):

  • When you visit our website or one of our contractors’ websites.
  • When you contact us in person or vice versa
  • When we collect information about you from third parties.
  • When you interact with us via social media or interactive applications including but not limited to Facebook, Linkedin and etc.
  • From publicly available sources.
  • Mobile services.
  • Other sources like IP Address, User Feedback Form/ Ticketing system, Information on Cookies.

3.0 Purpose of Processing your Personal Data

3.1 We may use your Personal Data for the following purposes (“Purpose“):

  • To enable us to provide our services and perform our services to you.
  • To facilitate your process orders.
  • Email you all important alerts.
  • Provide marketing updates to you.
  • To send you promotions and information on products and activities, offers to upgrade or other notifications in relation to your orders.
  • To protect the safety and well-being of yourself and/ or other customers.
  • To investigate and respond to claims from you.
  • To comply with any legal or regulatory requirements.
  • To remind you to complete your orders and/ or offer our assistance (in case, for instance, failure to complete due to technical difficulties). This is an optional service. You can choose not to receive these emails at any time by following the link at the bottom of each such email.
  • Contacting you for product or customer satisfaction surveys and market research.
  • For statistical analysis so that we can better understand our customer profile and improve our services to you.
  • For all other purposes ancillary to any of the purposes stated above.

4.0 Disclosure to Third Parties

MHP may disclose your personal data to our affiliates or third parties that perform services on MHP’s behalf and in doing so we will comply with all applicable laws, regulations and industry standards

5.0 Accessing / Limiting / Correcting / Updating Your Personal Data

In certain circumstances, you have the following data protection rights:

  • The right to access, update or to delete the information we have on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you.
  • The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
  • The right to object. You have the right to object to our processing of your Personal Data.
  • The right of restriction. You have the right to request that we restrict the processing of your personal information.
  • The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where MHP relied on your consent to process your personal information.

6.0 Retention of Data

6.1 We will not retain your personal data longer than necessary for fulfilling the Purpose. However, relevant Personal Data may be retained subject to the conditions below:

  • As and when required under legislation.
  • Where legal actions have arisen and are pending.
  • Commercial/ operational purposes of ours.

6.2 We shall take all reasonable steps to ensure that all Personal Data is destroyed or permanently deleted when no longer required for the Purpose.
